There are different types of joint property ownership, and owners can therefore select the option that is best suited to their own needs and circumstances.
Joint tenants, or beneficial joint tenants, each enjoy an equal share in their jointly-owned property. This is often the most attractive option for couples who are buying a home together. As the rule of survivorship will apply, meaning that if one co-owner dies, the other will automatically take sole ownership of the property. However, neither of the co-owners is able to transfer their share to someone else at any time when a joint tenancy is in place.
For tenants in common the rule of survivorship will not apply, meaning that they are free to choose who will inherit their share of the property when they make their Will. A tenants in common arrangement may be suitable for co-owners who each own different shares in the property, or in cases where a group of people wish to make a shared purchase.
