When commercial disputes are raised, it is important to know how to address them, whether you are a tenant or a landlord. We have outlined the process below:
The court emphasises that litigation should be the last resort, ensure that you have tried to resolve the dispute externally before taking this step.
You are encouraged to find an alternative way of resolving your dispute, only if this is impossible, should you resort to litigation. Instead, you could consider the following:
Litigation can be expensive, and you should seek advice on how much court proceedings might cost. Be aware that litigation is often unpredictable, so it can be hard to estimate costs accurately without professional assistance.
Before the trial, the parties exchange written statements containing the evidence of their witnesses. These are usually the ‘evidence in chief’ of the witness, which means that there is no need for the witness to give oral evidence. A witness is usually then cross-examined the statement at trial.
Although it is possible to rely on a witness statement as evidence at trial, a witness not being called to give oral evidence may affect the weight given by the court to that witness’s evidence. Further, the other party can apply to court for permission to call the witness to be cross-examined.
