Conveyancing can be a complex and sometimes lengthy process, so we are here to keep the process as simple and stress-free as possible. Most UK flats are sold as leaseholds, meaning that the buyer will own the property for a specified number of years, as set out in the lease. The duration of a lease can vary from 99 to 999 years, and the property can still be bought and sold during this time.
The freeholder is the person or company that owns the property. The leaseholder is the person purchasing the lease. They are responsible for paying yearly ground rent to the freeholder and for any property maintenance or repairs that are required.
Most houses in the UK are ‘freehold’ properties. This means that the owner, or freeholder, can do whatever they wish, subject to planning regulations. There are however a few exceptions, including:

Purchasing a new build property is not the same as purchasing a standard property. Purchasing a new build can consist of buying the property before its physical state, in other words, in an ‘off plan’ state, before the property has been built on the associated plot of land.
This gives the buyer the opportunity to customize the property as they wish. When going through a mortgage, you may find that new builds offer regulations such as exchange taking place before the mortgage offer is released to the buyer.
If you are planning to buy a new build, you will be required to pay a reservation price to secure the property and to ensure you use a conveyancer that is well informed about the ins and outs of the new build conveyancing process.
